Coronavirus, COVID-19, Emergency Paid Sick Leave, Extended FMLA, CARES, PPP loans (not to mention social distancing and isolation orders)…the emergency actions taken in response to the coronavirus have disrupted all aspects of our lives, in particular the workplace.

On April 8, 2020 (and again on April 13 and 14, 2020), the Small Business Administration (SBA) issued new “Frequently Asked Questions” providing clarifications regarding various aspects of the Paycheck Protection Program (PPP) loans established through sections 1102 and 1106 of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act or the Act).

Nonprofit organizations—just like for-profit businesses—are adjusting to new ways of operating. Events have been canceled, travel postponed, and staff displaced to home offices. Last weekend, the Small Business Administration, in partnership with the Department of Treasury, published an interim final rule regarding Paycheck Protection Program loans available under the Coronavirus Aid, Relief, and Economic Security Act (CARES Act).

The Small Business Administration (SBA) responded favorably to faith-based organizations’ concerns about Paycheck Protection Program (PPP) and Economic Injury Disaster Loan (EIDL) loan funding by issuing a new regulation which includes an express commitment to protect religious liberty in the administration of these loans. Additionally, over the weekend, the SBA issued a set of FAQs for faith-based organizations about the SBA loan programs.
